[Q 624] Qurbani for Deceased

QUESTION:

A question to respected scholars
If a person wants to give qurbani on behalf of their deceased mother; do they have to give their own additional wajib qurbani as well? I’ve heard on madani channel that their wajib qurbani would be done with the qurbani for their mother; please tell me if I understood this ruling correctly.

ANSWER:

Yes! You have understood the stated issue correctly, because if a person performs qurbani on behalf of a deceased without their wasiyyat, then that same qurbani will also fulfill their own Wajib qurbani. They do not need to perform a separate sacrifice. The reason for this is that the purpose of performing qurbani on behalf of the deceased is to convey its thawab (reward) to them, while in reality the act of sacrifice takes place in the ownership of the one performing it. Therefore, their own Wajib is also fulfilled through it.

Imam Qazi Khan رحمۃ اللہ تعالی علیہ writes:

”ولو ضحّى عن ميت من مال نفسه بغير امر الميت جاز. وله أن يتناول منه ولا يلزمه أن يتصدق به؛ لأنها لم تصر ملكا للميت بل الذبح حصل على ملكه. ولهذا لو كان على الذابح أضحية سقطت عنه“

Meaning: If a person performs qurbani on behalf of a deceased from their own wealth without the instruction of the deceased, then it is permissible. He may also eat from its meat, and it is not necessary for him to give it all in charity, because it does not become the property of the deceased; rather, the sacrifice occurs in the ownership of the one performing it. For this reason, if qurbani was obligatory upon the one performing the sacrifice, it will be fulfilled through this same qurbani.
