[Q 630] Repeating Fajr With Jama‘ah After Praying Alone

QUESTION:

If a person has prayed his own fajr salah without Jama‘ah, and then he sees Jama‘ah taking place after, can he re pray fajr with Jama‘ah.

ANSWER:

Without a valid Shar‘i (Islamic legal) reason, not performing Salah with Jama‘ah is Tark-e-Wajib, Na-Jaiz (impermissible), and a sin. However, if someone has already performed the prayer and then the Jama‘ah commences, then if it is the Zuhr or ‘Isha prayer, he should join the Jama‘ah with the intention of Nafl. But if it is the Fajr, ‘Asr, or Maghrib prayer, then he will not join the Jama‘ah again. Rather, the ruling for such a person is that he should leave the mosque. Therefore, in the situation being asked about, the mentioned person will not join the Jama‘ah.

Imam Ahl-e-Sunnat Sayyidi A‘la Hadrat عليه الرحمة states: “The person who has already completed his prayer individually in the mosque and then the Jama‘ah is established — if it is Zuhr or ‘Isha, then Shar‘an (according to Islamic law) it is Wajib upon him to join the Jama‘ah so that he may be protected from the accusation of opposing the Jama‘ah. And in the remaining three prayers, the ruling is that he should leave the mosque so that the appearance of opposing the Jama‘ah does not become necessary.”
