QUESTION:
If doing Hajj al-Badal (Hajj e Tamattau with permission) is the Qurbani from the person who went to perform the Hajj or from the person who paid for the Hajj?
Does the person who is performing the Hajj still need to give his own Wajib Qurbani if he has gone to do Hajj al-Badal on behalf of someone else?
ANSWER:

الجواب بعون الملک الوھاب اللھم ھدایة الحق والصواب
The person who sent someone to perform Hajj al-Badal (Hajj performed on someone else’s behalf) and instructed him to perform Hajj al-Tamattu (a form of Hajj combining ‘Umrah and Hajj with separate ihram for each), will also be responsible for the cost of the Qurbani (sacrifice) offered in gratitude for the Hajj.
As for the person performing the Hajj al-Badal, the Eid al-Adha Qurbani (Eid sacrifice) will only be Wajib (obligatory) upon him if he is Sahib al-Nisab (possessor of the minimum required wealth) and is also Muqeem (resident). If, however, he is a Musaafir (traveller) – as is the case for those who come from other countries for Hajj – then the Eid Qurbani will not be obligatory upon him.
It is mentioned in Rad al-Muhtar:
“(ودم الإحصار) لا غير (على الآمر في ماله ولو ميتا) قيل من الثلث، وقيل من الكل. ثم إن فاته لتقصير منه ضمن، وإن بآفة سماوية لا. (ودم القران) والتمتع (والجناية على الحاج) إن أذن له الآمر بالقران والتمتع وإلا فيصير مخالفا فيضمن (وضمن النفقة إن جامع قبل وقوفه) فيعيد بمال نفسه (وإن بعده فلا) لحصول المقصود.”

It is mentioned in Fatawa Hindiyyah:
“ويجب الدم على المتمتع شكراً لما أنعم الله تعالى عليه بتيسير الجمع بين العبادتين، كذا في فتاوى قاضي خان.”

Also, in Rad al-Muhtar:
“والذبح له أفضل ویجب علی القارن والمتمتع، وأما الأضحیة فإن کان مسافراً فلا یجب علیه وإلا کالمكي فتجب، کما في البحر”.
