[Q 306] Performing Istilam in Tawaf

Question

How many times should Istilam be performed during Tawaf, and where is it necessary to perform Istilam?

Answer

Kissing the Black Stone (Hajar Aswad), touching it with the hand or a stick and then kissing it, or indicating towards it and kissing the hands is called Istilam. Performing Istilam at the start and end of Tawaf is Sunnah Muakkadah (emphasized Sunnah) and Mustahab (recommended) in the remaining rounds.

Apart from Hajar Aswad, Istilam of Rukn Yamani is also performed. However, it is Mustahab and there is no harm iif it is missed. The difference in Istilam between Hajar Aswad and Rukn Yamani is that Rukn Yamani is only to be touched with one or both hands without kissing it. If due to crowd or any other excuse, it is not possible to touch Rukn Yamani, then it should not be indicated from afar with hands. Indication with hands for Istilam is only to be done for Hajar Aswad.

It is narrated from Ibn Umar رضي الله تعالى عنه:

لم أر النبي – صلى الله علیہ وسلم – يمس من الأركان إلا اليمانيين

Translation: “I have not seen the Prophet صلى الله عليه وسلم touch any part of the Ka’bah except the two Yemeni corners.”

In Fatawa Alamgiri, it is stated:

وصفة الإستلام أن يضع كفيه على الحجر ويقبله يفعل ذلك إن أمكنه من غير أن يؤذي أحدا وإلا مس الحجر بيده وقبل يده وإن لم يستطع ذلك أمس الحجر شيئا في يده من عرجون وغيره ثم قبل ذلك الشيء كذا في الكافي فإن لم يستطع شيئا من ذلك يستقبله ويرفع يديه مستقبلا بباطنهما إياه

Translation: “The method of Istilam is to place both palms on the stone and kiss it, if possible without causing harm to others. If unable to do so, one should touch the stone with their hand and kiss the hand. If even this is not possible, one should touch the stone with something in hand like a stick, and then kiss that thing, as has been mentions in “الكافي” (fiqh text). If none of this is possible, one should face the stone, raise their hands with palms facing it.”

It further states:

كلما مر بالحجر في الطواف يستلمه إن استطاع من غير أن يؤذي أحدا وإن لم يستطع يستقبل الحجر ويكبر ويهلل كذا في فتاوى قاضيخان، ويختم الطواف بالإستلام كذا في الهداية وإن افتتح الطواف بإستلام الحجر وختم به وترك الإستلام فيما بين ذلك أجزأه وإذا ترك رأسا فقد أساء كذا في شرح الطحاوي، ويستلم الركن اليماني وهو حسن في ظاهر الرواية كذا في الكافي، وإن تركه لا يضره

Translation:”Whenever he passes by Hajr al-Aswad, during Tawaf he will do istilam (by touching and kissing) if it is possible without causing harm to other. And if it is not possible then he will do istilam from afar, alongside takir and tahlil like it has been mentioned in fatawa Qadi Khan, and he will end tawaf with istilam as has been mentioned in Hidaya. and if he starts and finishes tawaf with istilam whilst leaving it for the other rounds then it will be sufficient. And when he completely leaves istilam then indeed it is wrong as has been mentioned in Sharh al-Tahawi, and it is better to do istilam of Rukn Yamani, as has been mentioned in al-kafi, however if he leaves it there is no harm.”

Regarding Rukn Yamani, in Al-Maslak Al-Mutawassit Fil Mansak Al-Mutawassit, it is mentioned:

والمراد بالإستلام ھنا لمسہ بکفیہ أو بیمینہ من دون تقبیلہ ثم عند العجز عن اللمس للزحمۃ لیس فیہ النیابۃ عنہ بالإشارۃ

Translation: “The meaning of Istilam here is to touch it with both hands or with the right hand… without kissing it. If unable to touch due to the crowd, there is no substitute by indication.”

In Al-Ikhtiyar Lita’lil Al-Mukhtar, it is stated:

واستلام الحجر أول الطواف وآخره سنۃ وما بقی بینھما أدب ویستحب أن یستلم الرکن الیمانی

Translation: “Performing Istilam at the start and end of Tawaf is Sunnah, and in between is Adab (etiquette). It is recommended to perform Istilam of Rukn Yamani.”

In Fatawa Tatarkhaniya, it is mentioned:

وإن استلم فی أولہ وآخرہ یکون مقیما للسنۃ ولا یضر ترکہ فیما بین ذلک فھذا دلیل علی أن الإستلام فی الإبتداء والإنتھاء سنۃ وفیما بین ذلک أدب وفی شرح الطحاوی وإذا ترکہ رأسا فقد أساء

Translation: “Performing Istilam at the start and end of Tawaf fulfills the Sunnah and there is no harm if missed in between. This indicates that Istilam at the beginning and end is Sunnah and in between is Adab. If completely missed, it is considered wrong.”

Regarding Rukn Yamani, Al-Hawi Lil-Qudsi mentions:

“وأما الرکن الیمانی إن استلمہ فحسن وإن ترکہ لم یضرہ”

Translation: “As for Rukn Yamani, if Istilam is done, it is good; if missed, there is no harm.”
