[Q 404] Ruling on Donating Human Organs

QUESTION:

Is it permissible to donate organs?

ANSWER:

بسم اللہ الرحمن الرحیم
الجواب بعون الملک الوھاب اللھم ھدایة الحق والصواب

It is not permissible to donate human organs, whether the donation is made during one’s lifetime or through a will after death. This is because human organs are neither classified as wealth nor as something that can be owned. Therefore, it is not permissible to transfer ownership of these organs to someone else.
Additionally, a human being is to be respected in their entirety, both during life and after death. Hence, removing any part of the body and using it in any way or deriving any benefit from it is unlawful and strictly Haram.

It is stated in Saheefa Majlis-e-Shar‘i:

Benefiting from a human organ is not permissible even in cases of necessity or extreme urgency, as found in Bada’i al-Sana’i, Kitab al-Ikrah, and this is explicitly stated in other books of Fiqh as well.
