Question
Is a Muslim allowed to get phone insurance ?
بسم الله الرحمن الرحيم
الجواب بعون الملك الوهاب اللهم هداية الحق والصواب
Answer
It is not permissible for a Muslim to get mobile insurance. The fundamental reason for its impermissibility is that it contains elements of gambling (qimar) and oppression (zulm), and both of these are forbidden in the Shari’ah.
The form of gambling is that the person obtaining the insurance continues to pay installments to the company for a specified period. If, during this period, the insured item is damaged, the company provides compensation according to the agreement, which sometimes amounts to much more than the installments paid. And if no damage occurs during this period, the company keeps all the money, and the person who obtained the insurance receives nothing. And this is what is called gambling.
The form of oppression (zulm) will manifest in this way: if the item sustains any damage, even though the company itself did not cause that damage, the company is still bound by the agreement to compensate for it. It is also not permissible in the pure Shari’ah to hold an innocent party responsible for a loss.
