QUESTION:
If someone laughs in Salaah, does it have to be audible sound from the mouth for it to break wudhu?
Does sniggering count as laughter?
ANSWER:
The ruling regarding laughing in Salaah (prayer) and its effect on Namaaz (prayer) and Wudhu (ablution) is as follows:
If an adult, while awake, laughs with Qahqahah (loud laughter — meaning such laughter that, if another person were nearby and there was no obstruction, they would be able to hear it) in a prayer that contains Rukoo‘ (bowing) and Sujood (prostration), this action breaks Wudhu and also invalidates the Namaaz.
If the laughter is to the extent that only one’s own ears can hear it, then the Namaaz is invalidated but the Wudhu is not broken. Therefore, if the laughter was such that others could hear it, both Namaaz and Wudhu are nullified. If it was only enough for one’s own ears, then the Namaaz is invalidated but not the Wudhu. And if no sound reached even one’s own ears, provided the environment is normal (not noisy) and one’s hearing is sound, then in this case neither the Namaaz nor the Wudhu is broken.
This ruling regarding Qahqahah (loud laughter) in prayers containing Rukoo‘ and Sujood is mentioned in Fatawa Aalamgiri, Muheet Burhaani and other books of Fiqh:
“و النظم للاول (و منھا القھقھۃ) و حد القھقھۃ ان یکون مسموعاً لہ و لجیرانہ۔۔۔ القھقھۃ فی کل صلاۃ فیھا رکوع و سجود تنتقض الصلاۃ و الوضوء عندنا، كذا في المحيط سواء كانت عمدا أو نسيانا كذا في الخلاصة۔”
(Al-Fataawa al-Hindiyyah, Kitaab at-Tahaarah, vol. 1, p. 12, Peshawar print, excerpt)
It is also written in Bahar-e-Shariat under the section of nullifiers of Wudhu:
“An adult’s Qahqahah (loud laughter), meaning such laughter that people nearby can hear, if done while awake in a prayer containing Rukoo‘ and Sujood, breaks Wudhu and invalidates the Namaaz.”
(Bahar-e-Shariat, vol. 1, p. 308, Maktaba-tul-Madina, Karachi)
Furthermore, at another place Sadr-ush-Shari‘ah عليه الرحمة states:
“Whatever invalidates the prayer also invalidates Sajdah (prostration), for example: intentional Hadath (nullification of purity), speech, and Qahqahah (loud laughter).”
(Bahar-e-Shariat, vol. 1, p. 731, Maktaba-tul-Madina, Karachi)
