[Q 657] Validity Of Overseas Qurbani

QUESTION:

we live abroad and send money for qurbani to pakistan . If in Pakistani eid is not on the same day if its one day before and we didn’t read eid namaz or we shave or cut the nails is our qurbani will b valid?

ANSWER:

According to the situation mentioned, if a person residing abroad has not yet reached the time of Subh-e-Sadiq (true dawn) of the 10th of Zul-Hijjah where they are living, then the obligation of Qurbani (sacrifice) has not yet become established upon them. This is because the obligation of Qurbani depends upon the time, and that time begins with the طلوعِ صبحِ صادق (appearance of true dawn) on the 10th of Zul-Hijjah. Therefore, if the Qurbani is carried out in Pakistan before the obligation has come into effect for that person, then their Wajib (obligatory) Qurbani will not be fulfilled, even if Subh-e-Sadiq has already occurred in the villages of Pakistan or even if Eid Salah has already been performed in the cities there.

However, once the person living abroad reaches the time of Subh-e-Sadiq on the 10th of Zul-Hijjah in the place where they are residing, then if the Qurbani is carried out in a village in Pakistan after Fajr time begins on the 10th of Zul-Hijjah, or in a city after Eid Salah has been performed at any place in that city, then the Qurbani will be valid — even if Eid Salah has not yet been performed in the country where the person on whose behalf the sacrifice is being offered is residing. This is because, in this matter, consideration is given to the place where the Qurbani is being performed, not the city or country of the person on whose behalf it is being done.

The references of the Fuqaha (Islamic jurists) regarding this matter are as follows:
Regarding considering the time of the person arranging the Qurbani, and that it is necessary for the 10th of Zul-Hijjah to have begun in his country, it is mentioned in Durr-e-Mukhtar ma‘a Radd-ul-Muhtar:

“أول وقتھا بعد الصلوۃ إن ذبح فی مصر و بعد طلوع فجر یوم النحر إن ذبح فی غیرہ والمعتبر مکان الأضحیة لا مکان من علیه.”

And regarding the consideration being given to the place where the Qurbani is taking place, it is mentioned in Fatawa Alamgiri:

“إن الرجل إذا کان فی مصر و أھله فی مصر آخر فکتب إلیھم لیضحوا عنہ فإنہ یعتبر مکان التضحیة فینبغی أن یضحوا عنه بعد فراغ الإمام من صلاته فی المصر الذی یضحی عنه فیه.”
