[Q 608] Offering Qasr Salah while in the state of Iqamah

QUESTION:

Mufti sahib my question is if a person performs a qaza namaz that was missed in the state of Safar as 4 rakaat will it be valid?

ANSWER:

If a person misses a 4 rakat Salah while traveling and he is offering its Qada while in the state of Iqamah, he will offer 2 rakat.
If one prays 4 Rakats instead of 2 when performing the Qada of a namaz that was missed in the state of Safar, there are 2 possibilities:

1. If one completed Qa’dah (sitting) in the second Rak’ah, his Fard will be fulfilled and the extra two rakats will be regarded as Nafl. There are 2 cases here as well:

a. If he prayed 4 Rak’at on purpose or he did not know the Shar’i Ruling, he would have to repeat his Salah. He will also have to repent as he purposely left a wajib.

b. If he did it forgetfully, he would have to do Sajdah Sahw at the end. If he does not do that as well, he will have to repeat his salah.

2. If one did not perform Qa’dah in the second Rak’ah, instead he stood up and completed 4 Rak’at, his Fard will be invalid and all 4 Rak’at will be considered Nafl.

It is stated in Fatawa Alamgiri:

إن صلى اربعًا وقعد في الثانية قدر التشهد أجزأته والأخريان نافلة ويصير مسيئا لتأخير السلام وإن لم يقعد في الثانية قدرها بطلت كذا في الهداية
