Question
With respect to the scholars, I wanted to ask a question for some guidance:
If someone takes cash in hand for work and does not declare it or pay tax on it, what is the ruling on that income, is it considered halal or haram? Does the tax evasion affect the permissibility of the earnings themselves, or are they treated as two separate matters in the Shariah?
بسم الله الرحمن الرحيم
الجواب بعون الملك الوهاب اللهم هداية الحق والصواب
Answer
The lawfulness (halal) or unlawfulness (haram) of earnings is related to the means by which they are acquired. If wealth is earned through a lawful and permissible means, then it will be halal, and if its means is unlawful (haram), then this wealth will be considered haram.
Paying tax on this wealth is a separate matter. Due to non-payment of tax, the wealth will not be considered haram.
Nevertheless, it should be remembered that a law of the state which is not against Shariah, and whose violation would lead to self-inflicted punishment and humiliation, should be followed as much as possible.
