[Q 625] Question about inheritance

QUESTION:

A person passed away and left behind 3 daughters and a sister. How will the inheritance be divided?

ANSWER:

In the mentioned situation, after paying for the necessary funeral costs, paying off any of the deceased’s debts and carrying out his will with (a maximum of) ⅓ of his wealth, the remaining wealth should be divided in 9 parts. 2 parts will be given to each of the 3 daughters and the remaining 3 parts will be given to the sister.

Important Note: The answer above is in the case where there are 3 daughters and a sister, and there are no other people alive who are entitled to the inheritance of the deceased according to Shari’ah. If any such person i.e a parent, grandparent,brother, son, grandchild, wife etc. was alive at the time of the death of the deceased, they will also get a part of the inheritance and the total calculation will be different. Therefore, one must make sure to include details of the existence of all such people when asking questions regarding the division of Inheritance so that every person is afforded what they deserve according to Shari’ah.
