[Q 299] Rulings for Severely Autistic Person

Question

What is ruling for a severely autistic person carrying out the farz of our religion like reading Salah, giving zakah, and performing hajj

Details:

The person can’t talk properly they make moaning noises to get attention from people like babies.

The person can’t walk properly.

The person has some awareness but not like a normal person.

The person needs lots of support with basic daily activities.

Answer

Based on the details you provided, this person seems to be in a state of ‘ma’tooh’ (mentally impaired) and a ma’tooh is a person whose intellect is impaired. Such a person is not obligated to perform the Fard acts of Shariah such as Salah (prayer), Sawm (fasting), Hajj, and Zakah. Nonetheless, for further clarification, it is advisable to consult your local scholar.

As stated in Fatawa Shami:

(قوله من العته) بالتحريك من باب تعب مصباح (قوله وهو اختلال في العقل) هذا ذكره في البحر تعريفا للجنون وقال ويدخل فيه المعتوه. وأحسن الأقوال في الفرق بينهما أن المعتوه هو القليل الفهم المختلط الكلام الفاسد التدبير، لكن لا يضرب ولا يشتم بخلاف المجنون اه وصرح الأصوليون بأن حكمه كالصبي إلا أن الدبوسي قال تجب عليه العبادات احتياطا. ورده صدر الإسلام بأن العته نوع جنون فيمنع وجوب أداء الحقوق جميعا كما بسطه في شرح التحرير.
