[Q 133] Judging Faith Based on Apparent State

Question

Is it permissible to have husn e zan on kafirs that they may have died on imaan?

Answer 

Regarding kufr (disbelief) and imaan (faith), we are obliged to consider the apparent state of every person.

Therefore, a person who is a Muslim will be considered a Muslim unless proven otherwise. Similarly, if someone, despite being called a Muslim, denies essential elements of the religion or commits any act of kufr, we will consider him a non-Muslim until his repentance is proven. If he does not repent or his repentance is not known to us, we must act according to the apparent, i.e., consider him a non-Muslim. No Muslim act can be performed in his funeral rites.
