[Q 126] Irrevocable Anger: Triple divorce (Talaq)

Question

I have said talaq 3 times one occasion through anger to my wife, does that mean we are divorced?

Answer

If your marital relationship with your wife has been established or after marriage both of you have separated in a place of solitude, then your wife has got three divorces. Now there can be no reconciliation without Shariah Halala.

Note: It is a sin to give three talaqs at once, but doing it in this way also results in three talaqs, so the person who does this must repent .

It is stated in Sunan Abi Dawood:

قال عويمر: كذبت عليها يا رسول الله إن أمسكتها، فطلقها عويمر ثلاثا، قبل أن يأمره النبي صلى الله عليه وسلم، قال ابن شهاب: فكانت تلك سنة المتلاعنين،

It is stated in another place in Sunan Abi Dawod :

عن سهل بن سعد، في هذا الخبر، قال: فطلقها ثلاث تطليقات عند رسول الله صلى الله عليه وسلم، فأنفذه رسول الله صلى الله عليه وسلم، وكان ما صنع عند النبي صلى الله عليه وسلم سنة

It is stated in Muwatta Imam Malik :

عَنْ مَالِكٍ أَنَّهُ بَلَغَهُ، أَنَّ رَجُلًا قَالَ لِعَبْدِ اللَّهِ بْنِ عَبَّاسٍ إِنِّي طَلَّقْتُ امْرَأَتِي مِائَةَ تَطْلِيقَةٍ فَمَاذَا تَرَى عَلَيَّ؟ فَقَالَ لَهُ ابْنُ عَبَّاسٍ «طَلُقَتْ مِنْكَ لِثَلَاثٍ، وَسَبْعٌ وَتِسْعُونَ اتَّخَذْتَ بِهَا آيَاتِ اللَّهِ هُزُوًا”

   It is stated in the book fath ul qadeer :

ذهب جمہور الصحابة والتابعین ومن بعدهم من أئمة المسلمین الی أنه یقع ثلاثاً ۔

Translation:” This is the opinion of the people, the Companions, the Tabi’een and the Imams of the Muslims that three divorces will occur.”

Imam Barr uddin aini says :

ومذهب جماہیر العلماء من التابعین ومن بعدهم منهم: الأوزاعي والنخعي والثوري، و أبو حنیفة وأصحابہ، ومالک و أصحابہ، والشافعي وأصحابہ، وأحمد و أصحابہ، و اسحاق و أبو ثور و أبو عبید وآخرون کثیرون علی أن من طلق امرأته ثلاثاً، وقعن؛ ولکنہ یأثم“۔

Translation: “The public scholars including the Tabi’in, the Taba’i Tabi’in, Hazrat Imam Uza’i, Imam Nakha’i, Imam Thori, Imam Abu Hanifa and his companions, Imam Malik and his companions, Imam Shafi’i and his companions, Imam Ahmad and his companions, Imam Ishaq Ibn Rahawiya, Imam Abu Thor, Imam Abu Ubaidah, may God have mercy on them, etc., hold the same opinion that whoever divorces his wife three times, then all three divorces will take place; However, because of that he will be a sinner.”

Sayyid Aala Hazrat Imam of Ahle Sunnat Imam Ahmad Raza Khan (may God bless him and grant him peace) says: “By giving three talaqs once, not only according to Hanafia, but also according to the consensus of Arbaa (imam of 4 schools), three talaqs have occurred . The Imam is not at all opposed in this matter. It is a sin to divorce three times at the same time, Zayd became a sinner and the woman was excluded from his marriage in such a way that now she can never marry him without Halalah . If they marry each other, both will be victims of fornication and will commit fornication throughout their lives.
